 Generally, the enforcement of codes occurs on both a reactive (complaint from a community source) and a proactive (initiated by the inspector) basis. There are however, a number of violations that are enforced after a complaint is received. These include Municipal Code and Zoning Ordinance violations. Our goal is to encourage both owners and tenants to voluntarily eliminate any violations that may exist so that Rolling Hills Estates remains a safe and desirable community.

 Compliance:

When a code violation is reported, we open a complaint and work towards resolving the violation through a process of education, inspection, and notices. Continued violations are followed by progressive enforcement. Each code has its own set of enforcement procedures, however, the process generally follows this sequence:

  1. Complaint received
  2. Inspection conducted
  3. Notice left at residence or sent to violator allowing time for correction (or citation and immediate correction depending on the violation. Example: illicit discharge)
  4. Re-inspection conducted after correction deadline – In some instances, correction may not be corrected within an immediate timeframe. (Some code enforcement cases involve planning review, engineering, private consulting with contractors, and building & safety department review/permitting. See examples below)  compliance
  5. Administrative Citations issued if violation is not corrected
  6. Criminal prosecution filed if not corrected after citation and other remedies exhausted (the City is subject to court proceedings).
  7. Lien Process for administrative citations: A city is authorized by state law to adopt procedures to collect unpaid administrative fines. Chapter 1.25 addresses administrative citations.
  8. Intercept Program : The State Controller’s office program called Interagency Intercept Collection Program”, which allows the diversion of overdue monies owed by an individual or entity from their income tax refunds at a minimal cost of $2.00 per “intercept”.

Example 1: Notice of Violation
Unmaintained Pool - An unmaintained pool (green pool) with stagnant water is a violation that requires immediate attention. All architectural pools, ponds, basins, fountains or any swimming pool or spa, or any body of water must be maintained and filtered to insure water does not become stagnate and become a health issue. The homeowner and Los Angeles County Vector Control is contacted for remediation. An example of a case such as this is typically corrected and closed within 48 hours and no further action is required.

Example 2: Administrative Citations  
Construction Stop Work Order- A homeowner and/or contractor conducts work on the property without proper City Approval and Permits (if required). The Code Administrator is notified and a case is opened. The Code Administrator reviews zone clearance files and permit issuance to verify the merit of the complaint. Confirmation of the complaint initiates an on-site contact and notice for an immediate Stop Work Order. The amount of construction and improvements to the home determine the duration of the code enforcement case and compliance. Improvements that involve engineering, importing and exporting of soil, plan submittal, plan checking and applications for planning commission often take a considerable amount of time. Administrative citations and double fees apply for violation and non-compliance.

Example 3: Criminal Prosecution
There are times when voluntary compliance is not achieved in code enforcement cases. Administrative fines are cumulative and citations may be issued each day the violation exists (RHEMC § 1.25.030).  When informal and formal efforts such as administrative citations and conferences fail to get compliance, the Code Administrator will initiate an appropriate progressive enforcement step.

Referral to the City Prosecutor for review and moving forward with issuing criminal charges.  In the event the case proceeds, the responsible party will be issued a subpoena to appear in court. The normal court proceedings will occur. This process is costly and takes a significant amount of time (months to years).

Alternative and/or additional options include a lien or intercept program.
